CSJ vs. DG Bureau of Public Enterprises: FHC To Rule On Plaintiff’s Notice of Discontinuation

The Federal High Court sitting in Abuja will on Wednesday rule on a notice of discontinuation application filed by the plaintiff in Centre for Social Justice (CSJ) vs. Director General Bureau of Public Enterprises.  This is coming after the defendant granted the plaintiff access to the information requested from it and on which premise the action was instituted at the court.  The case which was filed in 2020 by CSJ is an application under the Freedom of information Act about the details of the documentation evidencing the recovery of the sum of N7,585,116,400 by BPE.   CSJ sought information to show that the said amount has been paid into the Consolidated Revenue Fund which was 80% operating surplus due to be remitted to the Consolidated Revenue Fund for the year 2012 to 2016 but was not remitted by the Bureau. This was adjudged to be a violation of the Fiscal Responsibility Act 2007 and Finance Circular with reference No.BO/RVE/12235/259/vii/201 dated 11th November, 2011 and FMF/HMF/2015/1 dated 8th December 2015 and BO//REV//12235/259/vii/268 dated 7th July, 2014” as contained in page 306 of the 2017 Auditor General’s Annual Report on the Accounts of the Federation of Nigeria.  In the application, CSJ sought an order of mandamus to compel BPE to grant it access to documents showing that the said amounts were recovered and paid into the consolidated revenue account of the federal government.
